The Mohawk Council of Akwesasne will file federal action against Canadian officials over the closure of the border station on Cornwall Island.
The lawsuit will say that the closure is contrary to the mandate of the Canadian Border Services Agency to facilitate the free flow of goods and services.
Canadian officers left the station at the end of May and it was immediately occupied by Akwesasne Mohawks. The bridge linking Massena, NY to Cornwall, Ontario, has been closed ever since.

Mohawk Council of Akwesasne Files Federal Court Action Against theMinister of Public Safety and the President of the Canada Border ServicesAgency.The Mohawk Council of Akwesasne has instructed its lawyers to file anapplication for judicial review of the decision of the Minister of PublicSafety Peter Van Loan and the President of the Canada Border ServicesAgency Stephen Rigby to close the international port of entry located inthe Mohawk Territory of Akwesasne.The decision to close the Cornwall Port of Entry was obviously taken inhaste and is illegal and severely detrimental to the interests of theMohawks of Akwesasne and the surrounding communities that rely on thebridge. It is also contrary to the mandate of the Canada Border ServicesAgency to facilitate the free flow of persons and goods through the portof entry.The abrupt closure of the Cornwall Port of Entry has disrupted the livesof the Mohawks of Akwesasne and has put the Mohawks of Akwesasne at risk. The provision of health, sanitation, public safety, education, childwelfare and other basic services has been negatively affected by theclosure of the Cornwall Port of Entry. Local businesses have seen asubstantial effect on their revenues. Many Mohawks are now relying onboats to cross the St. Lawrence River in order to travel to their placesof work. Mohawks also report that the closure has put them to significantadditional costs.Many Mohawks are concerned that the decision to close the Cornwall Port ofEntry is a punitive and discriminatory measure in response to the exerciseby the Mohawks of Akwesasne of their fundamental freedom of expression andpeaceful assembly.Mohawk Council of Akwesasne will be seeking a declaration from the Courtthat the decision to close the international port of entry is invalid andunlawful and an order directing the Canada Border Services Agency to openthe international port of entry located on Kawehnoke and to delay thedeployment of firearms by the CBSA at the Cornwall Port of Entry pendingconsultations between Canada and the Mohawks of Akwesasne.--30--
