Elections Commissioner reinstated in Lewis County
Lewis County (Nathan Lehman WTNY) -- A court ruling has reinstated an elections commissioner in Lewis County.
Elaine McLear had been suspended by county officials without pay since December of last year following an investigation into allegations that she authorized payments to her daughter for work she did not do as an elections worker. McLear sued the county, and a judgment was reached in state Supreme Court last week.
Judge James McClusky ruled that only the governor has the authority to remove an elections commissioner from the position and not the county. McLear was ordered reinstated with full back pay and benefits.
The county is vowing to appeal the decision
