Hogansburg man indicted in Simonds murder

Federal authorities have issued another indictment in the robbery and murder of a Stockholm man earlier this year.

Acting United States Attorney for the Northern District of New York Andrew T. Baxter and St. Lawrence County District Attorney Nicole Duvé announced today the indictment of 31-year-old Bryan “Wildcat” Herne of Hogansburg on a charge of conspiracy to engage in a Hobbs Act robbery in the death of 31-year-old Daniel Simonds at his home on May 13th of this year.

Herne, along with the six previously indicted persons, is accused of planning to rob Simonds of marijuana and money. While at the residence, the group allegedly beat and shot Simonds before fleeing the scene. Simonds died of the gunshot wound seven hours later at a hospital in Vermont.

The Hobbs Act is frequently used in cases involving public corruption. Its use in this case is appropriate because the marijuana involved came from Canada, according to authorities.

If convicted, each defendant faces a maximum of twenty years imprisonment, up to a $250,000 fine and up to five years of supervised release following any period of incarceration.

The other defendants previously indicted are: Alan Jacobs of Hogansburg, Derek Cook of Hogansburg, Chad Edwards of Cornwall, Ontario, Anson Edwards of Cornwall, Ontario, Brian J. Latulipe of Bombay, and Kaientanoron L. “Nolo” Swamp of Snye, Quebec.
