(WTNY) -- New York Governor Andrew Cuomo is facing a lawsuit from a state teacher's union over New York's school tax cap.

State United Teachers says the law that limits property tax increases for school funding is unconstitutional and hurts low-income students. Cuomo pushed the two percent cap as part of his legislative agenda in 2011, but the union says such limits creates a wider disparity among school funding around the state. Cuomo has said the tax is needed to keep property taxes low in the Empire State.

The governor also notes that school districts and towns are allowed to exceed the cap if they get 60 percent support from voters or elected officials.
